These terms are the agreement between you and the person who runs Footbauction. They cover what the service is, what is expected of you while you use it, and what is not being promised.

Accepting these terms
Using the site means accepting them.
By using footbauction.com you agree to these terms. If you do not agree with them, please do not use the site. Because there is no account to create, there is no other moment at which to say yes — playing is the agreement.
If you are under the age of majority where you live, you should have a parent or guardian read these terms with you. Footbauction is not directed at children under 13.
What the service is
A free game, run by one person, for fun.
Footbauction is a free browser game in which a group of people bid for football players, build a starting eleven, and watch a simulated tournament decide a winner. There is no account, no sign up and no payment. Nothing bid or won in the game has any monetary value, and none of it can be exchanged, cashed out or transferred.
The auction is a game mechanic. It is not a real auction, no real transaction takes place, and the credits are simply numbers inside a match.
How to behave
Play the game; do not attack the service.
While using Footbauction, you agree not to:
- use the site for anything unlawful, or to harass, abuse or impersonate anyone;
- use bots, scripts or automated tools to bid, join lobbies or otherwise play on your behalf;
- interfere with the service or attempt to disrupt, overload or gain unauthorised access to it, to other players' sessions, or to the systems it runs on;
- probe or circumvent the game's rules, limits or security, or exploit a defect instead of reporting it;
- scrape, copy or redistribute the player data or the contents of the site as a dataset or a competing product.
If you find a bug or a security problem, the useful thing to do is write to contact@footbauction.com. It will be taken seriously.
Manager names
Everyone in the lobby sees what you type.
The manager name you enter is displayed to the other people in your lobby. You are responsible for what you type there. Names that are unlawful, hateful, obscene, or that impersonate somebody else, are not permitted, and may be removed along with the lobby they appear in.
You do not need to use your real name, and you are encouraged not to. What happens to that name is described in the privacy policy.
The game, the data, the names
Descriptive use, subjective ratings, no affiliation.
The game itself — its code, design, text, layout and artwork — belongs to the operator, and may not be copied, sold or redistributed without permission. You may play the game and share links to it; that is what it is for.
The player data was compiled manually, as part of a personal study of football history, by consulting a range of historical sources. It was not imported or adapted from any single dataset, website or game.
The ratings are subjective assessments made for the purposes of this game. They are not official statistics, they are not endorsed by anyone, and they are not offered as factual claims about any player's ability.
Footbauction refers to real footballers, and to names associated with well-known competitions, in order to describe the squads and pools a game can use. That use is descriptive. Footbauction is not affiliated with, endorsed by, sponsored by or connected to any club, league, competition, federation, governing body, player or media organisation. Any names referred to remain the property of whoever owns them.
If you hold rights in something that appears on the site and believe it should not be there, write to contact@footbauction.com, identify the material and where it appears, and it will be reviewed.
Advertising and third parties
Ads pay for a free game; they are not our content.
Footbauction intends to fund itself through advertising. When advertising is active, ads and any pages they lead to are provided by third parties, not by Footbauction. Their content, offers and practices are their own, and the operator does not endorse them and is not responsible for them. What that means for cookies and your information is set out in the privacy policy.
The site runs on infrastructure provided by third parties, and those providers have their own terms.
Availability and changes
A hobby project, not a utility.
Footbauction is provided as a free service and may be changed, interrupted, restricted or discontinued at any time, with or without notice. Lobbies, games in progress and the data in them may be lost, reset or removed — including in the middle of a match.
Access may be blocked where it is necessary to protect the service or the people using it, in particular where these terms are being broken.
These terms may be updated. The date at the top of this page is the date of the current version, and continuing to use the site after a change means accepting the updated terms.
Warranties and liability
Free game, no promises, honest limits.
Footbauction is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by applicable law. There is no promise that the site will be uninterrupted, error-free, secure against every threat, or that the player data and ratings are accurate or complete.
To the maximum extent permitted by applicable law, the operator is not liable for any indirect, incidental, special or consequential damages, nor for lost data, lost lobbies or lost games, arising out of your use of the site.
Nothing in these terms excludes or limits any right or remedy you have that cannot be excluded or limited under the law that applies to you, including consumer protection law in British Columbia and elsewhere. Where a limitation above is not permitted, it simply does not apply to you.
Governing law
British Columbia, Canada.
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts of British Columbia have jurisdiction, except where the law that applies to you as a consumer gives you the right to bring proceedings where you live.
If any part of these terms is found unenforceable, the rest continues to apply.
